Mediation is a voluntary, non-binding and 'without prejudice' process which involves the parties and their representatives sitting down with a mediator to discuss the issues in dispute, thereby moving towards a settlement.

A mediator is impartial; he/she cannot give advice on a best position basis and does not have the power to make a decision or award, but acts as a facilitator assisting the parties in negotiating a mutually acceptable solution.

A mediation begins with the mediator explaining the process and answering any questions. An agenda is then produced and each side is then given the opportunity to present their view of the dispute briefly and informally. The mediator then proceeds to meet with each party separately. The private, confidential sessions may continue until a settlement has been reached.

Over 75% of mediations result in a settlement on the day but even where total agreement is not reached the issues may have been clarified and narrowed.

Commercial mediations are held in our Truro offices which are offered as a neutral venue, thus reducing the cost of traveling out of County and additional fees incurred in hiring premises for the meeting.
