Litigants who had chosen to mediate their dispute reported that mediation had:

  • Avoided the stress of court proceedings
  • Significantly reduced their legal costs
  • Reduced conflict
  • Allowed them to reach their own agreement without judicial involvement
  • Often enabled them to see the other party's point of view
  • Given them closure on the matter

Whilst mediation is not a universal panacea, it is widely felt that cases that are assessed as suitable for mediation should be given every opportunity to embark on this alternative method of dispute resolution. This allows the Courts to concentrate on cases where one or both parties need the expertise of our Judiciary.
